    Short Term Rental Laws

    Single-family residences in Key Biscayne registered as STRs must comply with the minimum rental period of 15 days. While a property of this type may rent for a longer duration, it is not permitted to rent for a shorter period. Moreover, condominium units within associations with short term rental regulations must adhere to the specific by-laws of the condominium association. 

    Additionally, STR property owners may be subject to responsibilities in order to maintain the quality of the surroundings. The property owner must manage or delegate these tasks to each renter in order to preserve the neighborhood’s value and character. 

    Trash Schedule 

    North of West Mclntyre Street:

    • Garbage collection on Tuesdays and Fridays.
    • Recycling collection on Wednesdays.
    • Yard waste collection on Fridays along with garbage. 

    South of West Mclntyre Street:

    • Garbage collection on Mondays and Thursdays.
    • Recycling collection on Wednesdays.
    • Yard waste collection along with garbage on Thursdays.

    Noise Ordinance

    Noise is limited to the hours of:

    • 7:00 a.m. – 11:00 p.m. Monday-Thursday 
    • 7:00 a.m. – 12:00 a.m. Friday
    • 8:00 a.m. – 12:00 a.m. Saturday and Holidays
    • 8:00 a.m. – 11:00 p.m. Sunday

    Parking 

    Over occupying the premises is a common source of complaints among permanently residing homeowners. Therefore, parking must be kept entirely within the property. There should be no parking on swales or streets that interfere with local traffic.

    Other Regulations

    Other restrictions that may apply to an STR property include restricting maintenance companies from using gas-powered leaf blowers and keeping the property free of debris, in accordance with the Village of Key Biscayne Code: Property Maintenance Standards, Section 5-3.
